Introduction of investment procedures and forms of investment

FORMS OF INVESTMENT
Direct investment
Establish economic organizations with 100% foreign capital investment in water or 100% of foreign investment.
Established joint venture economic organizations between domestic investors and foreign investors.
Investment in the form of BCC, BOT, BTO, BT contracts.
Investment and development business.
Purchase shares or contribute capital to participate in the investment management activities.
Conduct investment business mergers and acquisitions.
Other forms of direct investment.
Indirect investment
Purchase of shares, stocks, bonds and other valuable papers;
Through securities investment fund; through other intermediary financial institutions.
Investment activities through the purchase and sale of shares, stocks, bonds and other valuable papers of organizations, individuals and the procedures for implementation of indirect investment activities in accordance with the law on securities and other relevant legislation.
PROJECT BY THE PRIME MINISTER approved INVESTMENT
The investment projects regardless of funding, the scale of investment in the following areas:
o Develop business and airports; air transport;
o Develop business and national port;
o Exploration, mining and processing of oil and gas; exploration and mining;
o Radio and television;
o Business casino;
o Production of cigarettes;
o Establishment of higher education;
o Establishment of industrial parks, export processing zones, high-tech zones and economic zones.
Investment projects not specified above, irrespective of the source of capital and investment capital of VND 1,500 billion or more of the following areas:
o Electronic Business; mineral processing; metallurgy;
o Construction of railway infrastructure, roads, inland waterways;
o Manufacturing and trading alcohol, beer.
Foreign-invested projects in the following areas:
o shipping business;
o Establish and provide postal service, delivery, telecommunications and internet; broadcasting network settings;
o Printing and distribution of newspapers;;
o Establishment of independent scientific research.
In case of investment projects in the plan (except for the project specified above) has been approved by the Prime Minister approved or authorized and meets the conditions prescribed by law and international treaties which Vietnam is a member of the investment certificate-granting agency procedures for granting investment certificates without having to submit to the Prime Minister decided to invest.
In case of investment projects in the plan (except for the project specified above) are not in the plan has been approved by the Prime Minister or authorized to approve the project or not meet the conditions for opening the provisions of international treaties to which Vietnam is a member of the investment certificate-granting agency shall, consult line ministries, the Ministry of Planning and Investment and other agencies related to the total case, the Prime Minister decided to invest.
TTrường investment projects in the plan (except for the project specified above) in areas not yet planned, the investment certificate-granting agency shall consult line ministries, the Ministry of Planning and Investment and other agencies related to the synthesis, the Prime Minister decided to invest.
PROJECT BY THE PEOPLE COMMITTEE INVESTMENT CERTIFICATES
Provincial People's Committees shall register investment, investment certificates to projects in the following provinces:
- Investment projects outside industrial parks, export processing zones, high-tech zones and economic zones, including projects already approved by the Prime Minister's investment policy;
- Investment projects of infrastructure development of industrial parks, export processing zones, hi-tech for those not yet established local management boards of industrial parks, export processing zones and hi-tech.
Department of Planning and Investment is the dossier-receiving agencies implement investment projects in the province under the jurisdiction of the provincial People's Committee.
For investment projects implemented on the many provinces and cities directly under the Central Government, but investors put or expected headquartered or operating branch or office to implement investment projects in province, the investment profile is submitted to the Department of Planning and Investment
DO PROJECT MANAGEMENT INDUSTRIAL AREA, HIGH TECHNOLOGY EXPORT PROCESSING ZONES, ECONOMIC AREA (hereinafter referred to as MANAGEMENT) INVESTMENT CERTIFICATES
Management Board shall register investment, investment certificates for investment projects in industrial parks, export processing zones, high-tech zones and economic zones in the province, including the project investment has been approved by Prime Minister investment policy.
Management received record investment project implementation in areas under Management Investment certification.
